StormView Terms of Use

1. Acceptance and Scope
These Terms of Use apply to your access to and use of StormView, a client-facing informational and analytical web application for exposure analysis operated by Peak Reinsurance Company Limited ("Peak Re", "we", "us", or "our"). By selecting "I agree", "Accept", or similar acknowledgement when logging in to or first accessing StormView, or by otherwise accessing or using StormView after being presented with these Terms, you agree to be bound by them. If you do not agree, you must not access or use StormView.
2. Who May Use StormView
Except for public legal, login, and informational pages, StormView is available only to authorised clients, Peak Re personnel, and other approved users who have been granted access by or on behalf of Peak Re. You may use StormView only for legitimate educational, analytical, portfolio review, client-engagement, or related business purposes that are consistent with your authority to access the service.
3. Account, Access, and Security
You are responsible for maintaining the confidentiality of your login credentials, authentication session, and any device or environment through which you access StormView. You must not share access, attempt to impersonate another user, or knowingly permit any unauthorised person to use your access. You must notify Peak Re promptly if you suspect unauthorised access, misuse, or a security incident affecting StormView.
4. User Uploads and Responsibilities
StormView allows you to upload files and submit information for analysis. StormView is designed for non-personal exposure data only, and you must not upload files or filenames containing personal data. You are responsible for ensuring that you are authorised to provide, upload, and process any data you submit through StormView, including any confidential, proprietary, or third-party material contained in those files.
You must ensure that your uploads do not breach applicable law, confidentiality obligations, contractual restrictions, intellectual property rights, or third-party rights. Peak Re may remove or restrict access to uploaded material if we reasonably believe it is unlawful, harmful, unauthorised, or inconsistent with these Terms.
5. Permitted and Prohibited Use
You may use StormView only for the permitted purposes described above. You must not:
- use StormView for any unlawful, fraudulent, or unauthorised purpose;
- upload malicious code, corrupted files, or content designed to disrupt the service;
- attempt to bypass authentication, access controls, rate limits, or security measures;
- scrape, harvest, or automate access to StormView except where expressly permitted;
- reverse engineer or decompile StormView except to the extent that applicable law does not allow that restriction; or
- use StormView in any way that could damage, disable, overburden, or impair the service.
6. Intellectual Property and Data Rights
StormView, including its software, interface, workflows, underlying methodologies, and product-generated materials, is owned by or licensed to Peak Re and its licensors and is protected by applicable intellectual property laws.
As between you and Peak Re, you retain ownership of any rights you hold in the data and files you upload. You grant Peak Re the limited rights necessary to host, copy, process, store, display, and transmit that content for the purpose of operating, securing, troubleshooting, supporting StormView, and delivering the requested analysis. Any use for service improvement is limited to aggregated or de-identified information, or is subject to separate permission.
StormView, including its non-public content, methodologies, outputs, screenshots, extracts, benchmark results, and access credentials, is confidential and made available only for the authorised purposes described in these Terms. You must not disclose, distribute, publish, reproduce, or make any such material available to any third party except to the extent expressly permitted by Peak Re or required by applicable law. This paragraph does not apply to the specific information that you can demonstrate is publicly available through no breach of these Terms, or that Peak Re has made publicly available without restriction; provided that any non-public compilation, selection, arrangement, analysis, methodology, output, benchmark result, screenshot, extract, or other material made available through StormView remains subject to this paragraph notwithstanding that it may incorporate or reflect information that is publicly available.
7. Outputs, Informational Purpose, and Use Limitations
StormView produces analytical outputs based on uploaded exposure data, configured parameters, processing logic, and supporting datasets, software, and services made available to the service. Those outputs are provided for general informational purposes only.
StormView does not constitute underwriting, reinsurance, actuarial, financial, legal, meteorological, or other professional advice. It does not represent Peak Re's official view of risk or pricing basis, and it is not a replacement for Peak Re's internal catastrophe models.
StormView must not be relied upon for pricing, underwriting, capital modelling, regulatory submissions, actuarial submissions, or other decision-making purposes, and must not be used as the sole basis for operational, investment, financial, compliance, or risk-management decisions.
You are responsible for assessing whether StormView and any output generated through it is appropriate for your purposes and for any use you make of StormView or its outputs.
For the avoidance of doubt, access to or use of StormView, and any output generated through it, does not constitute an offer, quotation, indication of capacity, agreement to renew, binder, cover note, commitment to provide reinsurance, or any other contractual undertaking by Peak Re. No reinsurance or other business relationship is created, amended, or confirmed through StormView except under separate written documentation expressly executed by the relevant parties.
8. Third-Party Data and Services
StormView may incorporate, depend on, or display information derived from third-party data providers, infrastructure providers, mapping services, software components, and other services. Certain datasets, software, or services may remain subject to separate terms, licences, availability constraints, or limitations outside Peak Re's control, and Peak Re does not guarantee the accuracy, completeness, availability, or suitability of such information, services, or outputs.
9. Availability, Suspension, and Changes
Peak Re may update, modify, suspend, limit, or withdraw any part of StormView at any time, including for maintenance, security, legal, operational, or service-improvement reasons. Peak Re may suspend or terminate your access if we reasonably believe your use of StormView is unauthorised, unlawful, harmful, or inconsistent with these Terms.
Peak Re may monitor use of StormView, investigate suspected misuse, unauthorised access, security incidents, or breaches of these Terms, and preserve, review, and disclose relevant logs, records, and other information to the extent reasonably necessary for security, legal, regulatory, audit, compliance, or enforcement purposes. Any processing of personal data in connection with StormView is also subject to the StormView Data Protection Policy.
Upon suspension or termination, your right to access and use StormView ceases immediately. You must stop all use of StormView, and sections relating to intellectual property, confidentiality, disclaimers, limitations of liability, governing law, dispute resolution, and any other provisions which by their nature are intended to survive shall continue in effect.
10. Disclaimer of Warranties
To the fullest extent permitted by applicable law, StormView is provided on an "as is" and "as available" basis. Peak Re does not guarantee that StormView or its outputs will be uninterrupted, error-free, secure, accurate, complete, current, available, or fit for any particular purpose.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Peak Re shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive loss, or for any loss of profit, revenue, business, goodwill, data, or opportunity, arising out of or in connection with your access to, use of, inability to use, or reliance on StormView or its outputs, including any loss arising from the use of, or reliance on, information or outputs made available through StormView. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law, including, to the extent applicable law so provides, liability for fraud, fraudulent misrepresentation, wilful misconduct, or gross negligence.
12. Changes to These Terms
Peak Re may update these Terms from time to time. The version published on this page is the version that applies at the time of use. Continued access to or use of StormView after updated Terms are posted may constitute acceptance of the revised Terms.
13. Business Use, Compliance, and Relationship with Other Terms
StormView is intended for business and professional use only by existing business customers of Peak Re, Peak Re personnel, and other approved business users, and not for personal, household, or consumer use. You must not access or use StormView in violation of any applicable sanctions, trade restrictions, export controls, or similar laws. If your access to or use of StormView is also governed by separate written terms agreed with Peak Re, those terms will prevail to the extent of any inconsistency with these Terms.
14. Governing Law and Disputes
These Terms are governed by and shall be interpreted in accordance with the laws of Hong Kong, without regard to conflict of laws principles. The courts of Hong Kong shall have exclusive jurisdiction to settle any dispute, controversy, or claim arising out of or in connection with these Terms or your use of StormView.
